Com a decisão, União assume a gestão do terminal em 1º de janeiro
O ministro Herman Benjamin, presidente do Superior Tribunal de Justiça (STJ), derrubou nesta segunda-feira (23) a liminar que mantinha a gestão municipalizada do Porto de Itajaí, até a conclusão de um processo de transição da Autoridade Portuária para o governo federal. Com a decisão no STJ, a federalização está autorizada e ocorrerá conforme previsto pela União, a partir do dia 1º de janeiro.
O Foro Metropolitano do Itajaí-Açu, que levou o caso à Justiça, ainda pode recorrer da decisão.
Na sentença, o ministro considerou que a liminar, concedida pelo Tribunal Regional Federal da 4ª Região (TRF-4), em Porto Alegre, extrapolou os limites da Justiça ao interferir em uma questão discricionária – basicamente, entendeu que cabe à União, como proprietária do porto, decidir sobre a administração do terminal.
O ministro também pontuou que houve crises no período de extensão da municipalização do porto, incluindo a paralisação dos serviços de dragagem e a dificuldade de arrendamento temporário do terminal, e alegou que o município de Itajaí demorou a ingressar como interessado na ação – o que só teria ocorrido no dia 20 de dezembro.
Por fim, Herman Benjamin afirma que a prorrogação do convênio de delegação da Autoridade Portuária ao município pode trazer prejuízos econômicos ao porto:
“Em contrapartida, os fatos de conhecimento público noticiados na petição da SLS (paralisação dos serviços por dificuldade de arrendamento para empresas que atuam nesse segmento, paralisação na dragagem do Porto de Itajaí) indicam que a prorrogação forçada, via judicial, do Convênio de Delegação é que pode causar lesão à ordem e economia públicas”.
O Foro Metropolitano informou que buscará “ações para buscar reparações financeiras junto à União, caso os prejuízos à economia regional sejam confirmados”. A entidade pretende procurar a Justiça “visando indenizações por investimentos não reconhecidos pela União e a continuidade da Ação Civil Pública, cujo mérito ainda será avaliado pelas instâncias judiciais”.
